TERMS & CONDITIONS

These Terms and Conditions (“Terms”) govern your use of www.susannabarasch.com (the “Site”), your communications with Susanna Barasch, and your purchase or use of tickets offered directly by Susanna Barasch or through a ticketing page that links to these Terms.
Throughout these Terms, “we,” “us,” and “our” refer to Susanna Barasch. “Event” means any concert, recital, performance, appearance, or related program presented or promoted by us.
By using the Site, submitting an inquiry, purchasing a ticket, or attending an Event, you agree to these Terms and our Privacy Policy. When tickets are sold through a third-party platform, that platform’s terms and policies also apply.


1. Use of the Site
You may use the Site for lawful, personal, and legitimate professional purposes, including learning about performances, purchasing tickets, requesting information, and contacting us regarding presenting or booking opportunities.


You may not use the Site to interfere with its operation, gain unauthorized access to any system, distribute malware, submit fraudulent information, impersonate another person, scrape or copy Site content through automated means, or engage in conduct that violates applicable law or infringes another person’s rights.


We may restrict or terminate access to the Site when we reasonably believe that a user has violated these Terms, misused the Site, or created a security risk.


2. Presenter and Professional Inquiries
Submitting a presenter, venue, booking, press, or professional inquiry does not:

  • Confirm Susanna Barasch’s availability;

  • Reserve or hold a date;

  • Create an agency, employment, partnership, or other professional relationship;

  • Constitute acceptance of a proposed fee, venue, date, program, or engagement; or

  • Create a binding performance agreement.

A performance engagement is confirmed only through a separate written agreement accepted by the appropriate parties.
Information submitted through an inquiry form is not treated as confidential unless we have separately agreed in writing to receive it confidentially.


3. Ticket Purchases
Tickets are subject to availability, applicable capacity restrictions, and any additional terms displayed on the Event listing or ticketing platform.
The ticket price and any mandatory charges will be displayed as required during the purchasing process. Taxes or other charges that may legally be displayed separately will be disclosed before payment is completed.

You are responsible for reviewing the Event date, time, location, ticket quantity, seating information, accessibility information, and other purchase details before completing your transaction.

A ticket is a revocable license permitting the ticket holder to attend the specified Event, subject to these Terms and the rules of the venue and ticketing provider. Tickets obtained through fraud, duplication, an unauthorized seller, or an invalid payment method may be canceled.


4. All Sales Are Final
All sales are final. Except where required by law or expressly stated otherwise, sales are nonrefundable. Ticket sales may not be exchanged for another Event, date, or performance.

Refunds, credits, or exchanges will not be provided because of:

  • Illness or personal emergencies;

  • Scheduling conflicts;

  • Travel delays, expenses, or difficulties;

  • Weather conditions that do not cause the Event to be canceled;

  • Failure to attend;

  • Late arrival or missed portions of the performance;

  • Seating preferences;

  • Changes to the announced program, repertoire, running order, accompanists, participating artists, or production elements;

  • Dissatisfaction with the Event; or

  • Removal from the Event for violating these Terms or venue rules.
     

Ticket transfers may be permitted when allowed by the applicable ticketing platform. The original purchaser remains responsible for communicating these Terms to anyone using a transferred ticket.

Any ticketing or processing fees are governed by the policies of the platform through which the ticket was purchased.

5. Event Changes, Postponement, and Cancellation
Event details may change when reasonably necessary. This may include changes to the repertoire, program order, accompanists, participating artists, venue, seating configuration, performance time, or production elements.

A change to the program, repertoire, supporting personnel, or production format does not ordinarily entitle the ticket holder to a refund.

If an Event is postponed or rescheduled, the original ticket will generally remain valid for the replacement date. Refunds will not be provided unless required by applicable law, required by the ticketing platform, or expressly offered by us.

If an Event is completely canceled and no replacement date is provided, any available refund or other remedy will be handled according to applicable law and the policies of the ticketing platform. Unless otherwise required, reimbursement will be limited to the amount actually paid for the affected ticket.

We are not responsible for transportation, lodging, meals, childcare, parking, or other expenses incurred in connection with an Event, including when an Event is changed, postponed, or canceled.

6. Admission and Late Seating
Admission is subject to ticket validity, venue capacity, security procedures, accessibility and safety requirements, and compliance with these Terms and all venue rules.

Late seating may occur only at an appropriate break in the program or at the discretion of Event or venue personnel. A late-arriving ticket holder may be required to wait, may be seated in a different location, or may miss part of the performance. Late arrival does not entitle the ticket holder to a refund.

Reentry, bag, food, beverage, dress, age, health, and security policies may vary by venue. Attendees are responsible for reviewing and following any Event-specific instructions.
Reasonable accessibility requests should be submitted as early as possible through the venue, ticketing provider, or info@susannabarasch.com. Available accommodations may depend on the venue and the amount of advance notice provided.

7. Audience Conduct
Every attendee must behave in a manner that protects the performance, the performers, venue personnel, and other audience members.

The following conduct is prohibited:

  • Threatening, abusive, violent, harassing, discriminatory, or intimidating behavior;

  • Excessive disruption, shouting, persistent talking, or deliberate interference with the performance;

  • Entering restricted, backstage, dressing-room, technical, or performance areas without permission;

  • Refusing reasonable instructions from venue, security, or Event personnel;

  • Dangerous, reckless, or unlawful conduct;

  • Possession of weapons, illegal substances, or prohibited items;

  • Smoking or vaping where prohibited;

  • Excessive intoxication or impairment;

  • Blocking aisles, exits, sightlines, or access routes;

  • Unauthorized solicitation, sales, distribution, or promotion;

  • Tampering with instruments, equipment, sets, lighting, decorations, or venue property; or

  • Unauthorized photography or recording.
     

Event and venue personnel may refuse admission or remove an attendee whose conduct violates these Terms, venue policies, or applicable law, or whose presence reasonably presents a safety risk or material disruption.

An attendee who is denied admission or removed for misconduct will not receive a refund. Serious incidents may be referred to venue security or law enforcement, and future admission may be denied.

8. Photography, Audio Recording, and Video Recording
Unless express permission is announced or provided in writing, the following are prohibited during the performance:

  • Audio recording;

  • Video recording;

  • Livestreaming;

  • Professional or commercial photography;

  • Flash photography;

  • Tripods, lighting equipment, or external recording equipment; and

  • Recording or distributing substantial portions of the performance by any means.
     

Personal, non-flash photography may be allowed before or after the performance or during designated portions of an Event, subject to venue rules and instructions from Event personnel.

Attendees must stop recording or put away a device when instructed. Unauthorized recording may result in removal without a refund, restriction from future Events, and enforcement of applicable intellectual-property rights.


Purchasing a ticket does not grant any right to record, reproduce, distribute, publish, broadcast, monetize, or create derivative works from the performance.

9. Event Photography and Promotional Recording
Events may be photographed, filmed, or recorded by us, the presenter, the venue, or authorized media personnel.

By entering an Event, you acknowledge that you may appear incidentally in audience photographs, video, or audio recordings. To the extent permitted by law, you grant permission for such incidental appearances to be used for Event documentation, publicity, editorial coverage, archival purposes, social media, and promotion without compensation.
An attendee with a particular privacy concern should contact Event personnel before the performance. Although reasonable efforts may be made, we cannot guarantee that an attendee will not appear in wide audience shots or background footage.

10. Assumption of Ordinary Event Risks
Attending an in-person Event involves ordinary risks associated with public gatherings. These may include crowd movement, loud sound, lighting effects, stairs, uneven surfaces, slips or falls, exposure to illness, actions of other attendees, and risks associated with traveling to and from the venue.

By attending, you acknowledge and voluntarily assume risks that are inherent in or ordinarily associated with attending a live public performance.

You are responsible for determining whether the Event environment is appropriate for you and for following posted warnings, venue policies, emergency instructions, and reasonable directions from Event personnel.

Nothing in these Terms excludes or limits liability for gross negligence, reckless or intentional misconduct, or any responsibility or legal right that cannot lawfully be excluded or waived.

11. Personal Property
You are responsible for your personal belongings. To the fullest extent permitted by law, Susanna Barasch, the presenter, the venue, and their respective personnel are not responsible for items that are lost, stolen, misplaced, left behind, or damaged during an Event, except to the extent that responsibility cannot legally be limited.
Found property may be transferred to the venue’s lost-and-found department and handled according to the venue’s policies.

12. Minors
A parent, guardian, or responsible adult must purchase tickets for minors and is responsible for determining whether the Event is age-appropriate.

Minors must comply with the same audience-conduct and recording rules as other attendees. The accompanying adult is responsible for supervising minors in their care and for promptly addressing disruptive or unsafe behavior.

Venue-specific age restrictions may apply.

13. Third-Party Platforms, Venues, and Links
The Site may link to ticketing providers, presenters, venues, payment processors, social-media platforms, or other third-party services.

Those services are operated independently and may have their own terms, refund rules, privacy policies, accessibility procedures, and security requirements. We do not control and are not responsible for the availability, content, security, or practices of third-party services.
When a third-party platform processes a transaction, its terms may also govern payment processing, ticket delivery, transfers, fees, chargebacks, and refunds.

14. Intellectual Property
The Site and its contents—including text, photographs, portraits, graphics, logos, designs, audio, video, performance clips, promotional materials, and other creative content—are owned by or licensed to Susanna Barasch and are protected by applicable intellectual-property laws.

You may view the Site and share links to publicly available pages for personal, noncommercial purposes. You may not copy, reproduce, modify, republish, sell, license, distribute, scrape, publicly display, commercially exploit, or create derivative works from Site or performance content without prior written permission.

Press and presenting organizations may use materials specifically designated as downloadable press or presenter materials only for legitimate coverage or promotion of an authorized engagement.

15. Site Information and Availability
We make reasonable efforts to keep Site information current and accurate, but we do not guarantee that every description, date, image, price, venue detail, or other item will always be complete or error-free.

We may correct errors, update information, change Site content, or temporarily suspend portions of the Site without notice.

The Site is provided on an “as available” basis. We do not guarantee uninterrupted access or that the Site will be free from technical failures, viruses, or other harmful components.

16. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, exemplary, or consequential damages arising from use of the Site, inability to access the Site, reliance on Site information, a third-party service, or a ticket transaction.
For claims arising solely from use of the Site or a ticket transaction—and excluding liability that cannot legally be limited—our total liability will not exceed the amount the claimant paid directly to us for the ticket or service giving rise to the claim.

Nothing in this section limits any liability or consumer protection that applicable law does not permit us to limit.

17. Privacy
Information collected through the Site is handled according to our Privacy Policy. Third-party ticketing, payment, venue, and social-media services process information according to their own privacy policies.

18. Changes to These Terms
We may update these Terms when the Site, Events, ticketing practices, or applicable requirements change.


Updated Terms will be posted on this page with a revised “Last updated” date. Changes will apply prospectively from the date they are posted, except where otherwise required by law.
The Terms in effect when a ticket is purchased will ordinarily govern that purchase, together with any Event-specific terms shown during checkout.


19. Severability
If any provision of these Terms is determined to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will continue in effect.


Our failure to enforce any provision on one occasion does not waive our right to enforce it later.


20. Applicable Law
These Terms are subject to applicable federal, state, and local law. Nothing in these Terms eliminates mandatory consumer rights or other protections that cannot legally be waived.
